SourceGeek Terms and Conditions

These terms and conditions (the "Terms") govern the use of the sourcegeek.com website and the SourceGeek platform — an AI assistant for recruitment teams available at chat.sourcegeek.com (the "Platform") — provided by SourceGeek VoF, Mozartlaan 33, 3603 BD Maarssen, the Netherlands ("SourceGeek", "we").

By creating an account or using the Platform you agree to these Terms, to our Privacy Policy and to the Data Processing Agreement, which forms an integral part of these Terms. The Platform is intended for business customers; by accepting these Terms you confirm that you act in the course of a business.

The Platform

SourceGeek provides an AI assistant that helps recruitment teams find and research candidates, score them against vacancies, draft documents and outreach, and — subject to explicit user approval — perform actions in systems the customer connects, such as an applicant tracking system, e-mail, calendar or messaging platform ("Connected Systems"). Work happens in workspaces; workspace administrators manage members, settings and the approval policy for actions on Connected Systems.

Accounts and workspaces

When creating an account you must provide accurate and complete information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at support@sourcegeek.com of any unauthorized use or security breach. You must not interfere with or disrupt the Platform, attempt to gain unauthorized access to it or to other customers' data, or use it to develop a competing product.

Subscriptions and billing

The Platform is billed per seat on a subscription basis, monthly or annually. Every new workspace starts with a free 14-day trial with full access; no payment method is required to start a trial. After the trial, continued use requires a paid subscription.

Subscriptions renew automatically for successive periods of the same duration unless cancelled. You can cancel at any time with a notice period of one month; cancellation takes effect at the end of the then-current billing period already paid for. Adding or removing seats results in a prorated charge or credit on your next invoice.

Certain usage of the Platform consumes usage credits included in your plan. Additional credits can be purchased, and workspaces can enable automatic top-ups; purchased credits are charged at the applicable rates shown in the Platform.

Prices are exclusive of VAT. Payment is collected through our payment provider; you must provide accurate and complete billing information, including business and VAT details where requested. If a payment fails and is not remedied after notice, we may suspend or terminate the subscription. We may change subscription prices; existing subscriptions are informed in advance and may cancel before the new price takes effect.

Refunds

Unless required by law, subscription fees and credit purchases are non-refundable.

AI-generated content

The Platform uses artificial intelligence. AI-generated output — including candidate summaries, scores, and drafted messages or documents — may be inaccurate, incomplete or outdated. You are responsible for reviewing output before relying on it or sending it, and for all decisions made using the Platform. Recruitment and hiring decisions must always be made by people, not by the Platform; the Platform is designed accordingly and does not make automated decisions with legal or similarly significant effects for candidates.

Connected Systems

You decide which Connected Systems to link to a workspace. By connecting a system you confirm that you are authorized to do so and that your use of that system through the Platform complies with its terms and with applicable law. Actions that create, change or delete data in Connected Systems require approval by a user in accordance with the workspace's approval policy, and are recorded in an audit log. Connected Systems are provided by third parties; SourceGeek is not responsible for their availability, conduct or policies.

Acceptable use

You must not use the Platform: in violation of applicable law, including data protection, employment and anti-discrimination law; to process data of candidates or other persons without a valid legal basis; to send spam or unlawful communications; or to infringe the rights of others. We may suspend accounts or workspaces that violate these Terms, where reasonably possible after prior notice.

Customer data

You retain all rights to the data you or your users submit to the Platform and to the data retrieved from your Connected Systems ("Customer Data"). We process Customer Data only to provide the Platform, as described in the Data Processing Agreement and the Privacy Policy, and using the sub-processors listed at sourcegeek.com/sub-processors. You can delete Customer Data during the term, including by deleting workspaces; deleting a workspace permanently erases its content.

Intellectual property

The Platform, including its software, design and branding, is and remains the property of SourceGeek and its licensors. To the extent SourceGeek holds any rights in output generated for you by the Platform, SourceGeek assigns those rights to you upon creation.

Availability and changes

We aim to keep the Platform available at all times but do not guarantee uninterrupted availability. We may modify the Platform, and will inform customers in advance of planned maintenance or changes that materially reduce its functionality, except in emergencies.

Liability

The Platform is provided "as is". To the maximum extent permitted by law, SourceGeek's total liability arising out of or in connection with the Platform in any 12-month period is limited to the amounts paid by the customer for the Platform in that period, and SourceGeek is not liable for indirect or consequential damages, including lost profits or lost data. Nothing in these Terms limits liability for intent or deliberate recklessness.

Termination

You can stop using the Platform and terminate your subscription at any time as described above. We may terminate the agreement if you materially breach these Terms and do not remedy the breach after notice. Upon termination, Customer Data is deleted as described in the Data Processing Agreement.

Governing law

These Terms are governed by Dutch law. Disputes are submitted to the competent court in the Netherlands.

Changes

We may modify these Terms. We will inform customers of material changes in advance; by continuing to use the Platform after the changes take effect you accept the modified Terms. If you do not agree, you must stop using the Platform and may cancel your subscription.
